End User License Agreement

1. Definitions

The following terms shall have the meanings set forth below throughout this Agreement:

• "Software" refers to the IndiaFont calligraphy application, including all components, features, updates, upgrades, patches, and accompanying documentation provided by the Licensor.
• "Licensor" refers to ArtoMania Studio Pvt Ltd, the developer, publisher, and rightful owner of the IndiaFont Software.
• "User," "You," or "Your" refers to the individual or legal entity that has obtained a license to use the Software through purchase or authorized distribution.
• "License" refers to the limited permission granted to you to use the Software in accordance with the terms of this Agreement.
• "License Key" refers to the unique alphanumeric code provided upon purchase that activates and validates your Software license.

2. License Grant

Subject to the terms and conditions of this Agreement and upon payment of the applicable license fee, the Licensor hereby grants you a limited, personal, non-exclusive, non-transferable, and revocable license to:

• Download and install the Software on a single computer or device that you own or control.
• Use the calligraphy fonts, tools, and features provided within the Software for creating designs and artwork.
• Export and use the output files (images, graphics, designs) for both personal and commercial purposes.
• Create one backup copy of the Software installation files for archival purposes only.

This license is granted solely for your personal or internal business use and does not include the right to sublicense, distribute, or transfer the Software to any third party.

3. License Types

3.1 Single User License

A Single User License permits installation and use of the Software on ONE computer or device only. The license is assigned to an individual user and cannot be shared, transferred, or used simultaneously on multiple devices.

If you need to change the device on which the Software is installed, you must first deactivate the license on the original device before activating it on a new one.

3.2 Subscription License

Subscription licenses (1-year or 5-year plans) grant access to the Software and all included features for the duration of the subscription period. Upon expiration:

• The Software will cease to function until you renew your subscription.
• You will retain access to any designs or files you exported during the active subscription period.
• Renewal must be completed before or shortly after expiration to maintain continuous access.

3.3 Lifetime License

A Lifetime License grants perpetual access to the version of the Software available at the time of purchase. This license includes:

• Unlimited use of the Software without recurring payments.
• Minor updates and bug fixes for the purchased version.
• Major version upgrades may require additional purchase, as specified in upgrade offers.

4. Restrictions on Use

You expressly agree NOT to engage in any of the following activities:

• Copy, duplicate, or reproduce the Software except for the authorized backup copy.
• Modify, adapt, alter, translate, or create derivative works based on the Software.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying algorithms of the Software.
• Rent, lease, lend, sell, sublicense, assign, or transfer your license rights to any other party.
• Remove, alter, or obscure any copyright notices, trademarks, or proprietary labels on the Software.
• Use the Software to develop or create any competing product or service.
• Share your license key or account credentials with unauthorized individuals.
• Download, install, or use cracked, pirated, or counterfeit versions of the Software.
• Extract, redistribute, or use the font files outside of the IndiaFont application.

5. Font Usage Rights

The fonts bundled with IndiaFont are subject to specific usage restrictions:

• Permitted Use: Fonts may be used to create designs, artwork, logos, graphics, and other visual content within the Software.
• Commercial Output: Exported files (PNG, JPG, SVG, PDF) containing font-based designs may be used for commercial purposes without additional licensing.
• System Installation Prohibited: Fonts CANNOT be extracted from the Software and installed as system fonts on your operating system.
• Redistribution Prohibited: Font files CANNOT be copied, shared, sold, distributed, or bundled with other products.
• Ownership: All font files remain the exclusive intellectual property of the Licensor.

6. Intellectual Property

The Software, including all fonts, graphics, code, user interface elements, and documentation, is the proprietary property of the Licensor and is protected by copyright laws, international treaties, and other intellectual property laws.

You acknowledge and agree that:

• The Software is licensed, not sold. You acquire no ownership rights through this Agreement.
• The Licensor retains all rights, title, and interest in the Software and its components.
• This Agreement does not grant you any rights to use the Licensor's trademarks, trade names, or brand identities.
• Any unauthorized use of the Software constitutes copyright infringement and may result in legal action.

7. Updates, Upgrades, and Support

The Licensor may, at its sole discretion, provide updates, patches, or new versions of the Software. Regarding these:

• Updates and bug fixes for your licensed version are generally provided at no additional cost.
• Major version upgrades (e.g., from V4 to V5) may require purchase of an upgrade license.
• Technical support is available via email, phone, and WhatsApp during business hours.
• Support scope and availability depend on your license type and may be subject to additional terms.

8. Data Collection and Privacy

The Software may collect certain anonymized usage data to help improve the product. This data may include:

• Feature usage statistics and frequency of use.
• Error reports, crash logs, and diagnostic information.
• System configuration details for compatibility analysis.

9. Termination

This license is effective from the date of activation until terminated. The license will automatically terminate if you:

• Fail to comply with any term or condition of this Agreement.
• Fail to pay applicable license fees when due.
• Engage in software piracy or unauthorized distribution.
• Attempt to circumvent license protection mechanisms.

Upon termination, all rights granted under this Agreement immediately cease, and you must:

• Immediately stop using the Software.
• Uninstall the Software from all devices.
• Destroy all copies, including backup copies, in your possession.

10. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
• WARRANTIES OF NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
• WARRANTIES THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

You assume all risk associated with the installation, use, and performance of the Software.

11. Limitation of Liability

IN NO EVENT SHALL THE LICENSOR, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE SOFTWARE.

THE LICENSOR'S TOTAL CUMULATIVE LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE LICENSE.

These limitations apply regardless of the cause of action, whether based on contract, tort, negligence, strict liability, or any other legal theory.

12. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of India, without regard to principles of conflict of laws.

Any disputes, controversies, or claims arising from or relating to this Agreement or the Software shall be resolved through:

• Good faith negotiation between the parties.
• If negotiation fails, binding arbitration in accordance with Indian arbitration laws.
• The exclusive jurisdiction of the courts located in Pune, Maharashtra, India.

13. Modifications to This Agreement

The Licensor reserves the right to modify, update, or amend this Agreement at any time. Changes will be effective upon posting to our website. Continued use of the Software after modifications constitutes your acceptance of the revised Agreement.
